Consumer forum slaps Rs 50 lakh compensation

ccc   (UNI) The State Consumer Dispute Redressal Commission, Uttar Pradesh, has ordered a doctor and a clinic in Varanasi to pay Rs 50 lakh to the family of woman who died due to medical negligence. In its judgement delivered yesterday, a three-member commission comprising SAA Rizvi, Presiding member, Ashok Kumar Choudhury and Alok Kumar Bose, both members, asked Dr Indu Singh CMD Surya Medical Hospital and Research Centre, Mahoorganj,Varanasi and Apollo Clinic, Mahoorganj, Varanasi to pay the amount within two months of the judgement. The Commission said Rs 30 lakh would be paid as compensation for the death of Prabha Tripathi(60) due to medical negligence and deficiency in service, while Rs 20 lakh for the wrong treatment. The judges also asked the petitioner to pay back all the reimbursement, they availed from IFFCO for treatment of Prabha Tripathi after they receive the compensation amount. The case was filed in 2009 by Raj Kumar Tripathi and his two sons Pawan and Amit of Tiwari Tola, Mohammadabad, Ghazipur district against Dr Indu Singh, Apollo Clinic and Indraprastha Apollo Hospital, New Delhi under section 17/13 of the Consumer Protection Act. The court, however, exonerated Indraprastha Apollo Hospital, New Delhi in the case. The Commission said that delay in paying the compensation by the respondent would lead to imposition of interest as per the Public Sector bank rate. The petitioners alleged that Prabha was admitted to the Surya Medical Hospital and Research Centre for uterus surgery on October 17, 2008 but due to medical negligence, she died on December 31, 2008 at Indraprastha Apollo Hospital, New Delhi. The petitioner Raj Kumar Tripathi, is one of the directors of IFFCO and Prabha Tripathi was his wife. UNI
